Open World Entertainment CEO’s appeal against his 6-year prison sentence rejected

The CEO of Open World Entertainment has seen his original sentence of 6 years in prison upheld after his appeal was rejected by the court on the 21st.

He was charged mid last year for sexually assaulting his female trainees, and was eventually sentenced to six years in prison. He appealed, but the original sentence of 6 years in jail as well as 40 hours in a sexual assault treatment program have been upheld. His file will also be available as public record for 5 years.

Although he had admitted to his crimes, he and his legal team had appealed asking for a reduction in sentence, saying, “He accepts all the charges and pleads guilty. But the defendant has worked hard for the spread of Hallyu in China, and is a true entrepreneur in the domestic entertainment industry.

However, the court was not swayed and turned down the appeal, while firmly stating, “He used his place of power after he signed a contract with the victims and violated their sexual rights and personal rights, and gave them mental pain that will be hard to heal throughout their entire life.”

"But the defendant has worked hard for the spread of Hallyu in China, and is a true entrepreneur in the domestic entertainment industry.”

LOL FUCKING DUMBASSES, THIS DOESN'T MEAN SHIT. thank god for such a shitty legal team. a better one and this asshat might have gotten off for his crimes.

not even surprised he only got 6 years considering the adults who sexually assaulted those mentally impaired children in a previous post got the same amount.
b1gay4 22nd-Feb-2013 08:22 am (UTC)
ikr i couldnt care less if he was fucking the president his dumb fatass needs 2 rot and slowly nd painfully in jail
turdferguson 22nd-Feb-2013 08:21 am (UTC)
6 years. that's not enough. the mental pains after sexual assault/rape linger for a lifetime. this person should never go back into society tbh
b1gay4 22nd-Feb-2013 08:23 am (UTC)

Can't believe he still have the nerve to request for appeal =.= 6 years is too light a sentence actually.

Sometimes I do think that if he was one of the big names we might have never heard of this
cast_no_shadow0 22nd-Feb-2013 12:48 pm (UTC)
Yeah, unfortunately I think if something like this were happening in the big 3, nothing would happen. I'm not really trusting of the SK legal system right now, or how much the government promotes and supports the "Hallyu Wave." The fact that this guy's legal team even attempted to appeal on those grounds indicates it does mean something...
modestgoddess79 22nd-Feb-2013 02:49 pm (UTC)
oh definitely, he could have got away with it if he was from a bigger company
bauci 22nd-Feb-2013 09:06 am (UTC)
I'm surprised he got that much, given the usual track record with these cases.
allegsiseu 22nd-Feb-2013 09:06 am (UTC)
I guess six years is like... 25 in Korea...
avieyal 22nd-Feb-2013 11:31 am (UTC)
lol hopefully there's an unwritten rule that 1 Korean jail year= 5 regular "international" years?

Seeing these short sentences now makes me wonder about South Korean jails. Are they so bad that judges feel short sentences are enough? If anyone has interesting sites or articles about it feel free to share links ^^
jasmineakaiumi 22nd-Feb-2013 04:42 pm (UTC)
That's an interesting theory, haven't thought of that
supplanter 22nd-Feb-2013 05:51 pm (UTC)
I dunno, even if you get longer sentences in some other countries, you get out on parole for good behavior (though I hear it's a little better to just serve it and get it over with in the US, because if you're out on parole they've got their eyes on you, and if you have any infractions your sentence or parole just gets extended). Do they have parole in SK?
avieyal 23rd-Feb-2013 12:23 am (UTC)
They do, and the official correctional service site says this: http://www.corrections.go.kr/HP/COR80/cor_02/cor_2080.jsp (wtf is up with that site though? It looks so cheerful and happy and their mascot is way too cute for a prison that it becomes creepy)

I can't access the Probation Office site on this link http://seoul.probation.go.kr/HP/PRO81/ maybe its defunct or blocked in my country idk.

The Ministry of Justice site says

"Parole Committee, headed by the Vice Minister, is under the direct supervision of the Minister of Justice. Article 72 of the Criminal Act of Korea stipulates that parole eligibility shall be examined by a committee consisting of 5 to 9 members, including the chairman. The Minister of Justice can either name or recommend Parole Committee members, who are highly knowledgable and experienced in correctional affairs. Members are comprised of judges, prosecutors, lawyers and public officials working in the Ministry."

Of course these are things that are supposed to happen. How they follow the rules is another story.

The best info I got was from a reddit reply.

I had friends who were put in a South Korean prison (foreigner prison) on speculation of marijuana. 12 x 12 cell with a toilet and 6 inmates. The only food was a bowl of rice. If you overflowed the toilet, you were beaten by cell mates because someone had to sleep in that shit.

They were housed with murders, rapists, and fraud artists. Drugs were seen as the worst crime. You were repeatedly hit across the back of the legs with a billy club by guards for no reason.

This was the jail, apparently the prison was 10 times worse.

The only reprieve was friends bringing candy and paying a fortune to have it brought to you.

The world is a fucked up place. Glad you survived and still fight.

edit * of course South Korea. North would just kill you.

Sorry I can't be more legit than that. The other info I came across was always about foreigners in SK jails, and that was a joke. Army servicemen who get sentenced are basically sentenced to a small communal dorm for however many years. They are treated differently due to international laws/treaties. So those accounts don't really count (and just piss me off). The reddit was actually helpful since now I see that SK considers drugs to be the most heinous crimes and everything else is just whatever. :/
allegsiseu 22nd-Feb-2013 07:48 pm (UTC)
reminds me of the us tbh. i mean we take other crimes seriously as well, but our 'war on drugs' is absolutely ridiculous.
avieyal 22nd-Feb-2013 11:55 pm (UTC)
Thank you for that, quite enlightening.

I found this http://www.article2.org/mainfile.php/0204/94/ though I don't know how legit it is considering its a site I've never come across before, but it does seem to echo what the reddit reply said. I suppose it depends on the individual prisons too, since some prisons seem to be "good" enough that they test robot guards in them.
fantaesticbaby 22nd-Feb-2013 09:20 am (UTC)
6 years is not even close to enough.

And the fact that the defence are trying to say he should be excused because he helped spread the Hallyu? wtf? Because you really want sexual predators spreading the message of your country... ok
hisjulliet 22nd-Feb-2013 09:24 am (UTC)
agh 6 years.........
hellodee16 22nd-Feb-2013 09:24 am (UTC)
bastard should be grateful that it's only a pathetic 6 years.

I doubt he truly feels any remorse for his victims.
the only thing he is probably sorry about is not being able to get away with it.
toshi830 22nd-Feb-2013 09:32 am (UTC)

shineebambi 22nd-Feb-2013 07:07 pm (UTC)
6 years seems to little but fuck him for trying to reduce it cause hes spread hallyu
iznanassi 22nd-Feb-2013 07:57 pm (UTC)
“He accepts all the charges and pleads guilty. But the defendant has worked hard for the spread of Hallyu in China, and is a true entrepreneur in the domestic entertainment industry.”

If he accepts the charges he should just go the fuck to jail, you don't get to pass go and you don't get to collect any money. In the end did they combine the sexual assault charge into one or are the 6 years the cumulative amount he got for all the cases he was tried for. Was there more than one case to begin with?
genie17 23rd-Feb-2013 02:29 am (UTC)
What the hell? So it's right to shorten his sentence because he contributed to the Hallyu wave? Are you people crazy? Oh wait.....
mandyyy 23rd-Feb-2013 05:03 am (UTC)
Korean you will forever be ridiculous in my eyes, but you're making a step in the right direction. At least he wasn't able to buy his way out of this one.
