Prosecutors prepare to summon G-Dragon to court



Big Bang's G-Dragon will be summoned to an investigation for the violation of the Youth Protection Act and for lewd conduct.

The investigation will focus on G-Dragon's 1st solo concert last year, “Shine a Light”, which exhibited sexual and violent themes, and the fact that it was rated as "strictly prohibited for pre-teens under the age of 12".

The Eastern Seoul District Prosecutor official stated, “We are in the process of collecting and reviewing all the information on the subject matter,” then continued, “We will determine the specific time frame when G-Dragon will be summoned to this investigation after this.”

G-Dragon held his concert last December which included a sexy performance with a female dancer for his song, Breathe.

The prosecutors are seeking for reasons why “She’s Gone” and “Korean Dream”, which were banned by the same Act in November, were still added to the show.

The two songs mentioned are considered not suitable for minors and are prohibited for sale, rent, screening and/or distributing in any channels by this law.

Individuals who are convicted of lewd conduct according to the Article 245 will face fine not exceeding ₩ 5,000,000 and one-year imprisonment and the penalties for the violation of the Youth Protection Act are ₩ 20,000,000 in fines and three-year imprisonment.

A representative from YG Entertainment gave a statement on the issue saying, “YG will assist the investigators in this process and will take care of it on behalf of the client (G-Dragon)" and added, “we will hereby accept the decision and are responsible for the legal action taken according to the Act.”

So let me get this straight.
There were two laws that he broke and is currently be investigated for. One is for lewd conduct and the other is for performing the songs, correct? While the lewd conduct is questionable, I do think the performing the banned songs still stands because they never made the concert 19+ and there were obviously underaged fans in the audience. I think it'll be hard for him to get away with that. The lewd conduct one is more based on opinion however, I feel that he has a slightly higher chance of fighting against this one than the other one.

Just a question, were the tickets on sale before the ban or after? It doesn't really excuse him either way but I'm still curious lol.

The tickets sold out weeks before they slapped the parental advisory sticker and the ban on the two songs.

There is actually a technicality loophole. I'll just repost my reply to a previous comment.

Let's lay out the technical terms:

>Parental Advisory (19+) on the Heartbreaker album - Bars everyone under the age of 19 from buying the album and also prohibits business merchants from selling the album to anyone under 19.

>Ban on songs Korean Dream and She's Gone - Prohibits television broadcast and radio play for both songs before 10PM (supposedly to restrict exposure to minors).

From what I've read in previous articles, the ban never stated that the songs may not be performed at all in the presence of minors. If I understood correctly, it seems that the concert does not fall within the categorical restriction of the ban as there was no broadcast.

The 19+ rating is on the sale and purchase of the physical media form. The argument that the concert should have been rated 19+ because the album is 19+ is arbitrary. Now the concert DVD which would have been reviewed after release if not for those fancams may be classified as 19+ because it's already a media production, but the concert performance in itself is a different matter.

Plus, prior to the concert, the Korean Media Rating Board, the organization that rates stage performances among other things and hence gave the concert its 12+ rating, should already have an idea of what will go on in the concert. The backlash should therefore be aimed at the KMRB. Although, if the supposed concert content presented to KMRB is a watered down version of what actually transpired, then there's a problem.

I'm obviously thinking too much on this that I should probably apply as defense counsel. LOL.
